Garofolo<\/a><\/p>\n<p>The Department of Labor recently cited\u00a0<em>ERISA Benefits Litigation: An Empirical Picture<\/em>, 28 ABA J. Lab. &amp; Emp. L. 1 (2012) (\u201c<em>ERISA Benefits<\/em>\u201d), in\u00a0its proposed regulation regarding disability benefit plan claims procedures.\u00a0 <em>See<\/em> 80 Fed. Reg. 72014, 72016 n.8 (Nov. 18, 2015).\u00a0 <em>ERISA Benefits<\/em> is a study by Sean M. Anderson, a professor at the University of\u00a0Illinois College of Law,\u00a0that most ERISA practitioners\u2014regardless of whether they focus on disability claims\u2014will find fascinating.<\/p>\n<p>Professor Anderson analyzed data relating to ERISA benefits\u00a0lawsuits filed between 2006 and 2010.\u00a0 He\u00a0found that\u00a0disability suits\u00a0accounted for 64.5% of benefits\u00a0litigation whereas lawsuits involving health care plans and pension plans accounted for only 14.4% and 9.3%, respectively.\u00a0\u00a0<em>ERISA Benefits<\/em>\u00a0at 7.\u00a0 According to the study, defendants asserted failure to exhaust\u00a0in 27.8% to 40.4% of\u00a0lawsuits in which disability benefits were not involved.\u00a0\u00a0<em>Id. <\/em>at 11.\u00a0 In contrast, failure to exhaust was asserted\u00a0as a defense in\u00a0only 14.7% of the disability cases.\u00a0 <em>Id.\u00a0\u00a0<\/em><\/p>\n<p>Professor Anderson has indicated that he intends to further analyze the data that he has collected.\u00a0\u00a0The author believes that analysis of class action benefits litigation,\u00a0claims brought by providers\u00a0where numerous medical claims are litigated in a single lawsuit (often brought by providers), and the amount of monetary recovery sought in different types of benefits claims would be of interest to ERISA practitioners and policymakers.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Joseph A.
