Garofolo<\/a><\/p>\n<p>In the month of June, no fewer than five lawsuits were filed challenging the Department of Labor&#8217;s authority to promulgate the final regulation broadening the definition of fiduciary.\u00a0 Three suits were filed in Texas, one\u00a0was filed in the District of Columbia, and one was filed in Kansas.<\/p>\n<p>All but one of the lawsuits seek to vacate the entire fiduciary regulation\u00a0for failing to comply with the requirements of\u00a0the Administrative Procedure Act, including because the\u00a0regulation is\u00a0\u201carbitrary, capricious, . . . or otherwise not in accordance with law\u201d\u00a0as that\u00a0phrase is used in 5 U.S.C. \u00a7 706(2)(A).<\/p>\n<p>In the author&#8217;s opinion, these lawsuits face an uphill battle, at least with regard to their 5 U.S.C. \u00a7 706(2)(A) attack,\u00a0due to the standard of review applied by the Supreme Court.\u00a0 As the Court explained, \u201c[t]he scope of review under the\u00a0&#8216;arbitrary and capricious&#8217; standard is narrow and a court is not to substitute its judgment for that of the agency.\u201d\u00a0 <em>Motor Vehicle Mfrs.
